Starbucks Latte Case Moves Forward
On June 17, 2016, Judge Thelton E. Henderson of the United States District Court for the Northern District of California allowed class action claims to move forward against Starbucks. The lawsuit alleges that Starbucks’ lattes are underfilled pursuant to the company’s standard recipe, and that Starbucks misrepresented on its menu that its lattes contained “12 fl. oz.” for a Tall, “16 fl. oz.” for a Grande, and “20 fl. oz.” for a Venti.
In his ruling denying Starbucks’ motion to dismiss, Judge Henderson stated that “Plaintiffs have alleged plausible facts that a reasonable consumer would be misled by Defendant’s representations, and Plaintiffs have alleged those facts with the requisite specificity.”
“We are pleased that Judge Henderson allowed the case to go forward, and we look forward to pursuing claims on behalf of Starbucks latte purchasers,” said L. Timothy Fisher, one of the firm’s lawyers handling the matter.
