Refund Checks Mailed From Verizon Wireless Termination Fee Settlement

New York, NY – More than 137,000 checks were mailed last week to Verizon Wireless customers who were charged early termination fees from July 23, 1999 through August 10, 2008. The checks, which were issued from the $21 million settlement fund in White v. Cellco Partnership d/b/a Verizon Wireless, provide partial refunds for termination fees that were challenged as illegal contractual penalties. The compromise settlement was reached in July 2008, two weeks into a jury trial. The California Court of Appeal upheld the settlement in June 2010, paving the way for the settlement funds to be distributed. Class members will receive $67.49 for each $175 termination fee they paid. The largest refund check issued to a class member was for $1,147.34

“After a seven-year battle in several courts and also in arbitration, it is gratifying that the people who paid these illegal fees are finally getting some measure of justice,” said Scott A. Bursor, the plaintiffs’ lead trial counsel. “I’m also very pleased that the five class representatives who stepped up to bring this case were recognized by the court with incentive awards of $10,000 apiece.”
