November 23, 2011 Michaels Stores Data Breach Litigation Moves Forward On November 23, 2011, Judge Charles P. Kocoras of the United States District Court for the Northern District of Illinois ruled that plaintiffs sufficiently pled claims for violations of the Illinois Consumer Fraud and Deceptive Practices Act and for breach of implied contract. The class action lawsuit captioned In re: Michaels Stores Pin Pad Litigation, accuses Michaels of failing to adequately protect its customers' financial information and failing to adequately notify its customers of a widespread data breach that resulted in unauthorized withdrawals from customers' bank accounts. "Judge Kocoras's ruling is a significant victory, since it permits two of our claims to move forward toward discovery and class certification," said Joseph I. Marchese, one of the firm's partners handling the matter. Judge Kocoras had previously appointed Bursor & Fisher as Interim Class Counsel on June 8, 2011, to represent a proposed nationwide class of consumers who made in-store purchases at Michaels using a debit or credit card and had their private financial information stolen as a result.
