January 5, 2012 Bursor & Fisher, P.A. Wins Class Certification Motion in AT&T / Pacific Bell Lawsuit On January 5, 2012, Judge Barry Goode of the California Superior Court, Contra Costa County, granted a motion to certify a class of AT&T / Pacific Bell customers in California who paid late fees on their wireline telephone bills. The lawsuit, In re Pacific Bell Late Fee Litigation, Case No. C1000840, alleges that Pac Bell's late fees are contractual penalties that violate California law. "This class certification order is a huge victory for millions of customers of AT&T / Pacific Bell, who can now join together to challenge these illegal fees," said Scott A. Bursor, one of the firm's partners handling the matter. "We've had tremendous success in past cases challenging similar fees, including our $299 million trial victory in Ayyad v. Sprint, challenging Sprint's early termination fees. The claims against AT&T / Pac Bell are similar to the claims we took to trial in the Sprint case, and we hope to achieve a similar result."
