Class Certification Granted in Lawsuit Against Bayer Corporation
On March 19, 2025, the Honorable Kenneth M. Karas of the Southern District of New York issued an Opinion and Order granting Plaintiff’s motion for class certification in Newman v. Bayer Corporation, Case No. 7:22-cv-07087 (S.D.N.Y.). Plaintiff alleges Bayer misrepresented the serving size of its “One A Day” gummy vitamins, such that consumers paid twice as much for the product despite receiving half as many servings promised per bottle.
