Military Veteran Defeats Motion To Dismiss In Class Action Lawsuit Against VA Mortgage Servicer

On September 30, 2025, the Honorable Victor A. Bolden, United States District Court Judge for the District of Connecticut, largely denied Defendant Pennymac Loan Services’s motion to dismiss in Cyrus v. Pennymac Loan Services, 3:24-cv-01145 (D. Conn). Bursor & Fisher, P.A. represents James Cyrus, a U.S. Army and Vietnam War military veteran in a putative class action against Pennymac, a Veterans Affairs mortgage servicer, for allegedly forcing veterans to refinance their loans at higher interest rates using “bait and switch” tactics during the COVID-19 pandemic.
