Summary Judgment Defeated in Landmark ACAL Lawsuit Against the Museum of Ice Cream
On June 12, 2025, the Honorable Lizette Colon of the Supreme Court of New York, County of Richmond issued an Order denying Defendant’s Motion for Summary Judgment in the case captioned Cammayo v. 1and8, Inc. d/b/a Museum of Ice Cream, Index No. 150173/2024 (N.Y. Sup. Ct. Richmond Cnty.). Plaintiff alleges the Museum of Ice Cream violated New York Arts & Cultural Affairs Law § 25.07(4) by failing to disclose the total cost of its tickets, inclusive of all ancillary fees that must be paid in order to purchase the ticket, prior to the ticket being selected for purchase.
Judge Colon’s order is a tremendous victory as it marks the first ever decision on a motion for summary judgment under the ACAL. Plaintiff is represented by Philip L. Fraietta, Stefan Bogdanovich, and Eleanor R. Grasso.
