Lotrimin And Tinactin Class Action Settlement Secures Final Approval

On May 13, 2026, Judge Stanley Chessler of the United States District Court for the District of New Jersey granted final approval to a $4.85 million common fund settlement in Huertas et al. v. Bayer U.S. LLC et al., Case No. 2:21-cv-20021. The case involved the alleged benzene contamination of Lotrimin and Tinactin foot spray products. The settlement—the largest class action settlement involving the alleged benzene contamination of a consumer product—put an end to five years of litigation that included a precedent-setting victory in the Third Circuit, which Bursor & Fisher partner Max Roberts personally argued. In granting final approval to the settlement, Judge Chessler remarked that getting “the Third Circuit to agree with [plaintiffs] … given the existing law at the time and, frankly, even at this point” and “against firms like Covington & Burling is, indeed, a significant accomplishment and attests to the ability, efficiency, and dedication of plaintiffs’ counsel.”

Payments to class members with valid claims are expected to be distributed on or about August 11, 2026.
